JAKARTA (IndoTelko) - Indonesian Ministry of Communications and Information Technology (Kemenkominfo) said that it is now reviewing a regulation for Over The Top (OTT) players, which can be treated the same as the operator.
"Regulations for mandating the OTT to posses license similar to operators is now being discussed in Europe. We can follow the steps taken by the Europe after the regulation is implemented, then the regulation is being discussed for conditions in Indonesia," said the Minister of Communication and Informatic Technology Rudiantara after attending the Open Joint Association of Indonesian Internet Service Provider (APJII), lastnight.
According to him, if the the OTT must be licensed, then the proper license is as a service provider.
"We are aiming for the international OTT first, then the local OTT players, as they must be treated equally. I already urged foreign players to establish their companies in Indonesia, so they will not be surprised when the regulation is issued," he said.
He added that this license obligation provision would be more effective because there will be requirements that must be met by the OTT as telecommunication Operation Rights Fee (BHP).
"It is not enough just relying on Government Regulation No. 82 Year 2012 on the Implementation of the System and Electronic Transactions (PP PSTE). It only requires registration," he said.
Unfortunately, despite wanting to adopt European regulation on OTT, but Rudiantara is not willing to apply the tax for OTT transactions. "Maybe we can apply tax for OTT transaction later, not now," he said.
Previously, Europe is now discussing on treating OTT players as operators by requiring a service license in order to revise the regulation of the telecommunications sector in 2016. This regulation is issued in order to create a single European digital market which will set the OTT players and operators. (es)
